General terms and conditions of sale
These terms govern sales of engines, turbos, gearboxes, spare parts and components by LINEA TURBO SRL through lineaturbo.com, turbomotori.com and its related sales channels.
1. Seller and contacts
The seller is LINEA TURBO SRL, registered office at Largo Ochi 7, 25031 Capriolo (BS), Italy, VAT and tax number 04797050988, REA BS-642403, fully paid share capital EUR 4,000.00, certified email lineaturbo@pec.it.
Sales and after-sales contacts: info@lineaturbo.com, 030 6480582 / +39 392 844 5052. For technical issues relating only to the operation of the website, contact the website agency Zimak.Co at info@zimak.co; that address does not handle orders, payments, withdrawal, returns or warranty claims.
2. Scope
These terms apply to consumers, meaning individuals buying outside their trade or profession, and to business customers. Mandatory consumer rights prevail over any incompatible provision.
The applicable version is the one made available and referred to in the quote or order confirmation when the contract is concluded.
3. Website and product information
The website is mainly a catalogue and a tool for requesting information, quotes and orders. Submitting a form does not automatically conclude a contract or guarantee product availability.
Products may be new, remanufactured or used, as stated on the product page or quote. Images and descriptions are illustrative; the codes, specifications, condition and compatibility confirmed in writing prevail.
Customers must provide accurate vehicle and component information, including where requested the VIN, engine, gearbox, turbo and OEM codes. Compatibility is assessed from the information supplied and LINEA TURBO's written confirmation.
4. Quotes, orders and contract formation
The quote or order confirmation states price, availability, condition, any deposit or core return, shipping charges, estimated timing and offer validity.
The contract is concluded when LINEA TURBO sends written order confirmation after receiving the customer's acceptance. Advance payment alone is not acceptance by LINEA TURBO. If a product becomes unavailable after payment, the customer is informed and sums not due are refunded without undue delay.
5. Prices, VAT, payment and invoicing
Prices are in euros. Consumer prices include VAT unless a lawful and clear statement says otherwise; shipping, core deposit and optional services are disclosed before confirmation. For business customers, VAT treatment is as stated in the quote and invoice.
Payment is by bank transfer or another method stated in the order confirmation. Customers should verify that beneficiary and IBAN match LINEA TURBO's official instructions.
6. Shipping, delivery and transit damage
Delivery is made to the agreed address by carrier. Timing and cost depend on availability, destination, size and any core return. Where no other time is agreed, the statutory delivery period applies to consumers.
On delivery, check the number of packages and the outer packaging. For visible damage or anomalies, a specific reservation should be written on the carrier's document, with photographs sent promptly to LINEA TURBO. Failure to reserve does not remove mandatory consumer rights for defects or damage not apparent on delivery.
For consumers, risk passes when the consumer or their designated third party other than the carrier takes physical possession, unless the consumer independently chose a carrier not offered by LINEA TURBO.
7. Exchange sales and core returns
A used-core return is required only where the sale is expressly identified as an exchange or core-return sale. The quote states the component, minimum condition, deadline, transport method, deposit and chargeable value.
The core must be of the same type, include the required parts and meet the stated rebuildability conditions. LINEA TURBO inspects it and communicates the outcome. Deposits and core refunds follow the quote; any deduction must be explained by reference to the agreed conditions.
8. Installation and use
Parts must be installed by qualified personnel in accordance with manufacturer instructions and technical specifications, including cleaning circuits, replacing consumables and diagnosing the original cause of failure. Keep purchase and installation invoices, diagnostics and service records.
Warranty does not cover faults caused by incorrect installation, misuse, racing, lack of maintenance, contamination, overheating, insufficient lubrication or unauthorized modification where LINEA TURBO proves the causal link. Mandatory consumer rights remain unaffected.
9. Legal warranty for consumers
New and remanufactured goods sold to consumers are covered by the legal conformity warranty under Articles 128 et seq. of the Italian Consumer Code. LINEA TURBO is liable for lack of conformity existing on delivery and appearing within two years. For goods expressly sold as used, a shorter liability period is valid only if agreed and may not be less than one year.
Where goods lack conformity, consumers are entitled under the statutory conditions and without charge to repair or replacement and, where applicable, a price reduction or termination. Any additional commercial warranty supplements and never limits the legal warranty.
10. Warranty for business customers
For purchases made in the course of business or professional activity, Articles 1490 et seq. of the Italian Civil Code apply: defects must be reported within eight days of discovery and action is time-barred one year after delivery, unless mandatory law or a more favourable written commercial warranty provides otherwise.
To the extent permitted by law, the warranty concerns the sold component and excludes vehicle downtime, loss of profit, towing, travel, consumables and indirect loss unless otherwise agreed or liability cannot lawfully be excluded.
11. Warranty claim procedure
Contact info@lineaturbo.com promptly with order or invoice number, product code, mileage, installation date and evidence, fault description, diagnostics, photographs and relevant information. Before returning or further dismantling the product, wait for instructions except for urgent work required for safety or to prevent greater damage.
Return authorization organizes transport and inspection and does not restrict statutory rights. If non-conformity is confirmed, necessary costs are handled under applicable law; if the fault is not covered, LINEA TURBO communicates the outcome and any cost before further work.
12. Consumer right of withdrawal
A consumer concluding a distance contract may withdraw without reason within fourteen days from taking physical possession, subject to the exceptions in Article 59 of the Italian Consumer Code.
To withdraw, send an unequivocal statement within the deadline to info@lineaturbo.com or lineaturbo@pec.it, stating customer, order, products and receipt date. The model form in the Returns and Refunds Policy may also be used.
Withdrawal may be excluded only in legally permitted cases, including made-to-measure or clearly personalized goods, where disclosed before ordering. The statutory right does not apply to business purchases unless agreed in writing.
13. Return and refund after withdrawal
After giving notice, the consumer must return the goods within fourteen days, following instructions and using adequate packaging. LINEA TURBO provides the return destination; heavy goods and components must not be sent unannounced to the registered office.
The consumer bears the direct return cost if informed before purchase, unless LINEA TURBO agrees otherwise. The consumer is liable only for diminished value caused by handling beyond what is necessary to establish nature, characteristics and functioning.
LINEA TURBO refunds amounts due, including the initial standard delivery charge, within fourteen days after notice and by the same payment method unless agreed otherwise. It may withhold the refund until it receives the goods or evidence of return. Extra delivery costs above the least expensive standard option are not refundable.
14. Returns for error, damage or non-conformity
If the delivered product differs from the confirmed product, is damaged or lacks conformity, contact LINEA TURBO without unnecessary work and follow the return instructions. Where LINEA TURBO is responsible, returns and remedies are handled at no cost to the consumer under the law.
If a business customer orders the wrong code or supplies inaccurate data, any commercial return requires written acceptance and is subject to the terms communicated by LINEA TURBO. Consumers retain the right of withdrawal where applicable.
15. Complaints and alternative dispute resolution
Complaints may be sent to info@lineaturbo.com or lineaturbo@pec.it. LINEA TURBO will seek a direct solution. If a consumer complaint cannot be resolved, information about any competent ADR body and whether LINEA TURBO intends to use it will be provided on a durable medium under the Consumer Code.
The former European ODR platform was discontinued and has not been available since 20 July 2025.
16. Liability, force majeure and website continuity
Nothing excludes or limits liability for fraud, gross negligence, death or personal injury, defective products or other non-waivable rights. Any limitation for business customers operates only to the extent permitted by law.
LINEA TURBO is not liable for delay caused by unforeseeable events beyond its reasonable control, subject to notice and mandatory remedies. The catalogue may be suspended or updated without affecting concluded contracts.
17. Governing law and jurisdiction
Italian law applies. Consumers retain the mandatory jurisdiction of the courts of their residence or domicile where provided by law. For business customers, the Court of Brescia has exclusive jurisdiction unless otherwise agreed in writing.
18. Final provisions
Invalidity of one provision does not affect the others. Later amendments apply only to contracts concluded after publication unless required by law. Specific written terms in a quote or order confirmation prevail only insofar as they are compatible with mandatory law.
